How A Durable Power Of Attorney Works In Florida

A durable power of attorney is an official document that gives another individual the authority to act on your behalf. In Florida, the word “durable” means that authority stays in place even if you become incapacitated.

You choose who serves as your agent, and you define the scope of their powers. Florida law requires your signature, two witnesses’ signatures and a notary must acknowledge your signature.

Does Florida Allow A Springing Durable Power Of Attorney?

Florida no longer recognizes springing durable powers of attorney. A springing DPOA would only take effect upon a specific event, such as incapacity; however, Florida requires that a durable power of attorney take effect immediately upon signing.
