Can probate be expedited for urgent estate matters?

On Behalf of Guffey & Kostun Law Group | Sep 11, 2025 | Probate

When an estate is left to go through probate, the process can take several months, or even years, depending on the complexity of the assets and the number of heirs involved. But sometimes, there are urgent matters that require faster resolution. So, can probate be sped up? In some cases, it can.

What are the reasons for expediting probate?

Probate can be expedited in situations where immediate action is needed. For instance, if an estate has valuable assets that need to be sold or managed quickly, or if heirs face financial difficulties requiring faster access to funds, the court might allow the process to move more quickly. Certain debts, like medical bills or outstanding taxes, may also require fast handling to avoid interest or penalties from accumulating.

How can probate be expedited?

To speed up probate, certain steps must be taken. One of the first steps is filing a request with the court, asking for an expedited process. The court will review the request and determine if it meets the criteria for urgency. In some cases, the estate may be eligible for a simplified process if it meets specific guidelines, such as having a low value or few beneficiaries.

What factors influence the speed of probate?

The complexity of the estate is one of the main factors that determines how fast probate can go. If there are disputes among heirs or if the estate contains complicated assets like business interests, it may take longer. However, an estate that has clear instructions and minimal conflict can often be resolved more quickly, especially when expedited procedures are granted.

In certain circumstances, probate can be expedited to meet urgent needs, but the process depends on a variety of factors and the specifics of the estate. While it’s not guaranteed, taking the right steps can help speed things along.
